Is the pool insured during transport?

 

Well the short answer is “Yes,….but!”

 

• Penguin Pools – No insurance for transport. Their liability (other than warranty), ends once the pool leaves their gate.

• Other general carrier - $2000.00 cover per item (i.e. pool/s), up to 50 items per truck load.

• TAJE Pilot Services – Full replacement and transport up to $100,000.00, if transported on a TAJE vehicle.

 

 

Penguin Pools

Penguin pools does not hold any insurance for the carriage of pools from their factory to the customers site.

As Penguin Pools authorised transport company, TAJE Pilot Services maintains that insurance, and covers the pools if transported with our vehicle/s

 

Other General Carrier and/or hiab companies

Under the “Carriage of Goods Act 1979”( https://www.legislation.govt.nz/act/public/1979/0043/latest/whole.html), carriers, aka transport companies, are only required to have “Carriers Liability Insurance” (https://www.rothbury.co.nz/carriage-of-goods).

 

This insurance is normally limited to $2000.00 per unit (i.e. Pool).

 

Most companies also have Public Liability Insurance, however this does not cover goods.

 

TAJE Pilot Services

We have the following insurances:

• $20,000,000.00 Public Liability Insurance

• Professional Liability Insurance (For piloting)

• Carriers Liability Insurance (For moving freight on our trucks)

• Marine & Cargo Insurance (For fibreglass pools from Penguin Pools)

 

The Marine & Cargo Insurance insures the replacement of the pool, and transport, up to $100,000.00 per claim/incident.

 

This insurance is normally held by the manufacturers, but in this case, as we are the authorised transport company for Penguin Pools, we have taken this on board for Penguin Pools.

 

To reduce risk of having to use this insurance, the following apply:

• Only pools transported by TAJE are covered by this insurance

• Use of pool trailers will be used at our discretion, and normally only for local sites.

• This insurance does not cover getting the pool from the road at the customers site to the pool site, this is the liability of the pool installer or owner

• This insurance does not cover the lifting of the pool, which would be the liability of the hiab/crane company

• This insurance does not cover damage of the gel coat due to pools transported inside each other. This is the liability of the factory and comes down to how the pools are packaged.

 

In summary:

While you have the right to use whomever you want to transport your Penguin Pool, you need to ask the carrier what is the extent of their insurance?

 

An answer of “We have insurance” could mean your $30,000.00 pool could just get $2,000.00 reimbursement in the event of an incident! So make sure you get the specific insurance details.
